Industry stakeholders on Monday described the administration of Dr Afiz Ogun Oluwatoyin as a transparent one.

 

 

 

‘’The Director General/Chief Executive Officer of the Industrial Training Fund (ITF), Dr Afiz Ogun Oluwatoyin, is very sincere and is increasing awareness about training initiatives within the economy and impacting the lives and livelihoods of millions of businesses in Nigeria’’

 

 

 

The investors, community, government and trade union officials also praised Oluwatoyin’s unrelenting efforts in changing the face of the organization in all fronts, harnessing the potential of the youth, driving economic growth, beefing up revenue generation for the agency and empowering artisans in Nigeria with the knowledge, tools and resources needed to succeed in their respective fields.

 

 

 

The stakeholders in a statement issued in Abuja by the Secretary General of Manufacturing, Construction, Automobile and Textile Stakeholders Forum (MCATSF) , Alhaji Ibrahim Musa, commended Oluwatoyin for his purposeful leadership, pragmatic re-engineering of the organization and impact on the lives of Nigerians.

 

 

 

The statement excoriated a fictitious group, Concerned Workers, over a statement credited to it.

 

 

 

‘’The attempt by the fictitious group to cast aspersions on the integrity of Oluwatoyin by making unsubstantiated allegations about him and the organization is unfortunate’’

 

 

 

The stakeholders upbraided the group for misleading the public about the organization.

 

 

 

‘’The report is defamatory, insulting and entirely fictitious. This is just an attempt to deceive and mislead the public. All the allegations centred around the pull down syndrome on the part of some people who are insisting on the old order of corruption, anarchy and insanity.

 

 

 

They urged mischievous elements in the organization to forsake the club of evil doers and the society of organized dishonesty.

 

 

 

‘’This is a man with tremendous energy. Dr Oluwatoyin is a straightforward and hardworking Nigerian. He is also a strict disciplinarian, quietly efficient and has reputation for accountability’’

 

 

 

The statement emphasized a high degree of honesty, morale and productivity, passion for efficiency, conducive atmosphere, adherence to procedure, consultation, delegation of authority and concerns about competence.

Particularly, the stakeholders praised the world-acclaimed man of principles and integrity for his impressive performance, visionary attributes, expertise and profound understanding of the goals of the organization.

 

 

 

They listed operational changes in the organization, technical and entrepreneurial development as well as advisory services on micro, small and medium enterprises as key achievements of Oluwatoyin.

Minister of Works, Engr. Dave Umahi and the Managing Director of Foremost engineering construction company, Julius Berger Nigeria Plc, Dr. Lars Richter have both committed to ensuring the completion of the critical Bodo-Bonny Road, BBR project by year end. This is coming just as the minister suggested an additional N20billion augmentation fee to the contractor to cushion the effects of current economic realities in the country.

 

Speaking at the meeting, Umahi who was of the view that there was no need for any augmentation hoped that the additional amount N20bn which he announced there and then would assuage the contractor’s burden on the project.

 

The Minister reminded the stakeholders of the importance of the project to both the surrounding communities and the country, adding that when completed it will enhance development even as he gave the assurance to Bonny kingdom that the project will be completed by the end of 2024.

 

During his presentation, the Managing Director of Julius Berger Nigeria Plc, Engr. Dr. Lars Richter drew the attention of the Minister to the time lag when the contract was awarded in 2014 when the exchange rate was N305 to a dollar, adding that the cost of relevant construction materials have since risen by over 1000%.  Richter called for the variation of the contract which he said has become necessary in view of the declining value of the Naira and rising cost of construction materials in the country.

 

 

 

He said, I thank you all for coming and for giving me this opportunity to share more light on the project. Allow me to give you some insight from us on this project. This project was initiated in 2013 and today we are talking of 2024, which means the project is more than 11 years old. In 2014, we received the letter of award and the project couldn’t commerce. Then in 2017/2018, the NLNG stepped in with the infrastructure tax credit scheme for modalities in funding the project.

 

 

 

Lars said the company asked for the augmentation because as at the time the contract was drafted it was based on the exchange rate of N305. “And last year there were some developments in the economy which result to a huge change in prices of construction materials, diesel, among others. When we signed this project, we were talking of N142 per Liter for diesel. But today we are buying diesel for N1500/N1600 per Liter. In 2013 the price of bitumen is far cheaper than today that we buy the bitumen for N1.2 million.”

 

 

 

Contrary to media reports and details of the meeting that went viral Thursday, insiders confirmed that the augmentation fee requested by Julius Berger is N80bn and not N28bn as in the quote from the ministry which says the company requested only that amount.

 

According to BusinessDay newspaper in its report, “David Umahi, the minister of works disclosed this during a meeting with contractors and the peace committee on the project from Bonny Kingdom, in Abuja on Wednesday. He stated that the government do not have the funds to meet the N28 billion request made by the contractor (Julius Berger company).”

 

 

 

One stakeholder was quick to remark that, there is the urgent need to clarify how much the augmentation fee really is. He asked, is it N80bn or N28bn?

 

The stakeholder who vowed to formally disclose the facts and fictions of the media reports on the meeting said the facts as stated by Dr. Lars Richter in his speech at the occasion include the following; the original contract sum was N199bn. The company requested in August 2023 for augmentation of N289bn. By March 2024 a discount of approximately N10bn was given to bring the amount down to N279bn.

 

 

 

The representatives of the Community and Peace Committee also present at the meeting were very much in favour of Julius Berger completing the contract and commended the company on its progress, engagement of the community and social responsibility among others since the first inception of the Bonny NLNG plant and the subsequent commencement of the road project.

 

 

 

Leader of the Peace Committee delegates, Chief Abel Attoni expressed gratitude over the decision to complete the Bodo-Bonny Road project even as he urged the parties to be patriotic and make the necessary sacrifice for the actualisation of the project.

 

 

 

One of them, King Jasper Jumbo did not mince words in declaring that, Julius Berger used to be my biggest enemy, but with all the engagement they have been into since the Bodo-Bonny road project began, I have loved them and their commitment to the work. The federal government should ensure Julius Berger complete the road. And I want to see the road delivered in my life time.

 

 

 

Surprisingly too, the Bodo-Bonny Road project as at March, 2024 is only 65% completed as against the 80% being touted by ministry officials as stated by Dr. Lars Richter and confirmed by the committee constituted by Minister of Works within the Federal Ministry of Works including external Consultants, PEARL & NLNG

 

 

 

The 39 km long road is the first road link between Bonny Island to the rest of Rivers State. The road has cross culverts and two mini bridges with a span of 23m each as well as two creek bridges, Afa Creek Bridge of about 530m length and Nanabie Creek Bridge of about 640m length, in addition to the construction of a major river bridge of about 750m length over the Opobo Channel.

IDA Summit: VP Shettima Departs Abuja for Nairobi

Leads Nigeria’s ambition for robust global financing*

 

Vice President Kashim Shettima will depart Abuja today to represent President Bola Ahmed Tinubu at the crucial International Development Association (IDA21) Heads of State Summit taking place tomorrow in Nairobi, Kenya.

 

The high-level gathering, hosted by Kenyan President William Ruto, will see African leaders unite to call for an ambitious replenishment of the World Bank’s International Development Association (IDA) concessional lending arm.

 

VP Shettima is expected to take a lead role in advocating for Nigeria’s vision of a transformative IDA21 financing package to accelerate development across the continent over the 2024-2026 period.

 

In the draft “Nairobi IDA Communique” to be considered at the summit, African heads of state outline urgent priorities for IDA’s next three-year funding cycle, including building human capital, creating jobs, enhancing energy and digital access, building climate resilience, and promoting sustainable growth.

 

While thanking donors for contributing $23.5 billion to the current IDA20 cycle, the communique states that this level of financing is inadequate to meet the massive investment needs. It calls on “IDA partners/donors to step up and ensure a robust replenishment for IDA21.”

 

Vice President Shettima is expected to emphasize that partners like IDA will be critical to realizing Nigeria’s economic transformation agenda, with the country’s young population requiring substantial investments in sectors like job creation, energy access, and human capital development.

 

The Nairobi summit follows previous IDA gatherings in Abidjan in 2022 and Dakar last year where African leaders united to call for an ambitious IDA20 replenishment from donors.

CDWR Condemns Mass Sack of Water Corporation Workers and Demands Recall

 

We Say No to Privatization of the Water Corporation

 

The Campaign for Democratic and Workers Rights condemns the sack of about 370 workers of the Lagos State Water Corporation (LSWC) on Monday, April 15, 2024. Besides, the mass sack violates Section 20 of the Labour Act and was carried out under an atmosphere of intimidation and harassment wherein hundreds of armed security men were mobilised to the corporation head office where the termination letters were handed to the workers. Section 20 of the Labour Act mandates every employer including government to engage the trade union or workers representatives in a dialogue before redundancy or mass sack can be carried out. Lagos State Government refused to engage the union but resorted to brute force. We consider this action as callous and inhuman, especially at a period when even those who have jobs are devastated by a serious economic crisis caused by the anti-poor policies of Bola Tinubu government. Therefore, we demand their immediate reinstatement.

 

Before this sack, the staff strength was said to be about 590. This means about 63 per cent of the regular workforce has been sacked. Similarly in December 2023 over 450 casual workers were laid off. Many of them had worked for over 10 years but were made to remain on poor pay and without being converted to regular staff. We reiterate our call also for their reinstatement to regularised employment with all rights and benefits.

 

This series of mass sacks of workers is a step in the preparation of the Lagos State government to hand over the corporation to the private sector whose agenda is to exploit and extort the populace similar to what is obtainable in the electricity sector.

 

Government irresponsibility, neglect and underfunding of the water sector led to the failure to provide potable and safe water to the general public. This is the primary reason many people get water-borne diseases like typhoid fever, cholera, dysentery etc., which can lead to death According to UNICEF, 70% of water at the point of consumption is contaminated and as a result, 117,000 children die each year in Nigeria. Instead of privatising the water corporation that will engender corporate exploitation and poor service delivery, governments at all levels should invest public funds into the water sector with the agenda of providing safe, potable and affordable water to Nigerians.  

 

 

 

It is correct for the Lagos state chapter of the Amalgamated Union of Public Corporations, Civil Service Technical and Recreational Services Employees AUPCTRE to have written letters and requested meetings with the government over the mass sack. But beyond these steps, AUPCTRE should mobilise for a series of public and mass actions including demonstrations. We call on the state chapter of the Senior Staff Association of Statutory Corporations, Government-Owned Companies and Associated Organisations (SSASSGOG) to also intervene, and indeed we advocate for a joint struggle of the two unions.

 

 

 

However, the state chapter of AUPCTRE must be strengthened by the intervention of the national leadership of the union and the Lagos State NLC. The Nigeria Labour Congress and Trade Union Congress should mobilise other affiliates to join the struggle. It should be noted that if the mass sack and the planned privatisation of the Water Corporation succeed in Lagos State, it will be emulated by other states.

 

It is also important for AUPCTRE to counter the agenda to privatise with an alternative programme of public ownership and workers’ democratic control and management of the water sector to ensure efficiency and massive investment that can lead to the provision of potable, safe and affordable water to every home in Lagos State. This will help win the support of the public in their struggle.

PRESIDENT TINUBU CALLS FOR COLLABORATION, INCLUSIVENESS TO ADDRESS GLOBAL CHALLENGES AND WORK OUT ENDURING SOLUTIONS

President Bola Tinubu says collaboration and inclusiveness are invaluable to achieving global food security, addressing collective challenges, and driving innovation across a chain of interests for a more stable and prosperous world.

Speaking during a high-level panel session at the World Economic Forum Special Meeting on Global Collaboration, Growth and Energy for Development in Riyadh, Saudi Arabia, on Sunday, President Tinubu said “collaboration and inclusiveness”, especially with regard to Africa, are elemental to building a future of hope, peace, and progress for all.

He said capital mobilization, which is needed to spur economic growth and associated advancements in Africa, cannot be overlooked any longer.

The President posited that the continent is richly endowed but that the diversity of its resources must reflect in its wherewithal and economic realities.

“The capital formation that is necessary to drive the economy, agriculture, ensure food security, innovation, and technological advancement must be an inclusive programme of the entire world. No one should be left behind.

“I am glad the world is recognizing the need for cooperation, and that with the type of population growth that Africa is experiencing; the diversity of its resources must be married with economic opportunity. We must collaborate to achieve that,” President Tinubu said.

The President called on global leaders to pay attention to the developments in the Sahel, emphasizing the need for a studied understanding of the vectors of the current situation, while suggesting collaboration in the pursuit of enduring solutions.

“We are encouraging the entire world to pay attention to the Sahel and the other countries around us. As the Chairman of ECOWAS Authority of Heads of State and Government, I have wielded the big influence of Nigeria to discourage all unconstitutional change of government. Equally, we have eased the sanctions. We need to trade with one another; not fight each other. It is very necessary and compulsory for us to engender growth, stability, and economic prosperity for our people in West Africa.

“The rest of the world needs to look at the fundamentals of the problem; not just geopolitically, but at the root. Has the world paid attention to the poverty level in the Sahel and the rest of ECOWAS? Have they facilitated the infusion of capital and paid adequate attention to ensuring the exploitation of resources and the creation of opportunities presented by the mineral resources available?

“Are we going to play a big-brother role in a talkshop without taking necessary action? We just have to be involved in the promotion and prosperity of that region in order to see peace, stability, and economic growth,” President Tinubu said.

Detailing the steps taken to set Nigeria’s economy on the path of expeditious recovery, the President said he had to take tough but essential decisions like removing fuel subsidy – with its attendant perils – and managing the nation’s currency, effectively removing corruption-laden arbitrage.

“Concerning the question of subsidy removal, there is no doubt that it was a necessary action for my country not to go bankrupt and to reset the economy and the pathway to growth. It was going to be difficult, but the hallmark of leadership is making difficult decisions when they need to be made.

“That was necessary for the country. Yes, there have been drawbacks. Yes, there was the expectation that the difficulty would be felt by a greater number of people. But, of course, it was the interest of our people that was the primary focus of the government. Along the line, there was an arrangement to cushion the effect of the subsidy removal on the vulnerable population of the country. We shared the pain across the board. We cannot, but include those who are very vulnerable.

“Luckily, we have a very vibrant youth population interested in innovation and highly ready to leverage technology, good education, and who remain committed to growth. We were able to manage that and partition the economic drawback and the fallout of the subsidy removal equally; engendering transparency, accountability, and fiscal discipline for the country. And that, to me, is most important, which is focusing on what direction we should head in. I will pursue that rigorously.

“The currency management was necessary, equally to remove the artificial element of value in our currency. Hence, our local currency finds its level and competes with the rest of the world’s currencies as we remove corrupt arbitrage and opaqueness. That, we did. At the same time, that is a two-engine problem in a very turbulent situation for the government. But we are able to manage that turbulence because we prepared for this with inclusivity in governance and rapid communication with the public,” the President concluded.

In her remarks, Managing Director of the International Monetary Fund (IMF), Kristalina Georgieva commended President Tinubu for offering insights on how to execute strategic economic reforms.

“President Tinubu has emphasized the right things about what world leaders must consider primary in the execution of strategic economic reform. He said there is a need to ensure that reforms are accompanied by a human touch. The needs of people must be identified and catered to as governments implement tough but necessary reforms,” the IMF Managing Director said.

During the session, the President of Rwanda, Paul Kagame, who was also on the high-level panel, said: “I am happy that the Nigerian President spoke on the need for inclusive economic growth. Africa is the stage for an expanding middle class. As the growth of the middle class in developed economies stagnate, Africa’s middle class is growing. It is our human resources and not natural resources that make our continent strategic and central to the global community moving forward.”

PRESIDENT TINUBU MEETS CHAIRMAN OF DANISH SHIPPING GIANT MAERSK; SECURES $600 MILLION INVESTMENT IN NIGERIAN SEAPORT INFRASTRUCTURE

President Bola Tinubu has secured an investment of $600 million from Danish shipping and logistics company, A.P Moller-Maersk, to expand existing port infrastructure to accommodate more container shipping services in Nigerian ports.

Chairman of A.P Moller-Maersk, Mr. Robert Maersk Uggla, disclosed the decision during a meeting with President Tinubu on the sidelines of the World Economic Forum Special Meeting on Global Collaboration, Growth and Energy for Development in Riyadh, Saudi Arabia, on Sunday.

President Tinubu noted that this investment will complement the administration’s ongoing $1 billion investment in seaport reconstruction across the eastern and western seaports of Nigeria.

The President added that it would further support the country’s port modernization efforts and port process automation through his administration’s implementation of the national single window project, which is aimed at enhancing trade facilitation, easing import/export flow, reducing corruption at the ports, while improving the efficiency and transparency of port processes in Nigeria.

“We appreciate your business and the contribution you have made and continue to make to our country’s economy over time. We do not take our partners for granted. A bet on Nigeria is a winning bet. It is also a bet that rewards beyond what is obtainable elsewhere.

“More investment opportunities are available, and my government has worked on various reforms to encourage investments. We need to encourage more opportunities for revenue expansion and minimize trans-shipments from larger ships to smaller ships,” he said.

The President assured Maersk of his administration’s commitment to collaborating and creating an enabling environment for businesses to thrive in the country.

He cited Maersk’s previous partnership in the development of the Ogun State container terminal as a testament to fruitful partnerships with the reputable logistics company.

Highlighting Maersk’s longstanding engagement in Africa’s most populous nation and his belief in the future of Nigeria, Chairman of A.P Moller-Maersk, Mr. Robert Maersk Uggla said his company had made significant investments of over $2 billion in Nigerian ports and other activities.

He emphasized the potential for Nigerian ports to accommodate larger container ships and stressed the need for expanding port infrastructure to meet this demand while reducing the cost of logistics.

”We have seen a significant opportunity for Nigeria to cater for larger container ships. Historically, most of the West African coasts are already served by smaller ships. Currently, we see an opportunity to deploy larger ships to Nigeria. To achieve this, we need to expand the port infrastructure, especially in Lagos, where we need a bigger hub for logistics services. The growth potential is hard to quantify.

”We believe in Nigeria, and we will invest $600 million in existing facilities and make the ports accommodating for bigger ships.

”In my humble view, given that Nigeria is the most populous country in Africa, Nigeria should have the best and biggest port and we are very eager to invest, and we will continue that dialogue with the relevant Nigerian authorities to explore further investment opportunities,” the Maersk Chairman said.

President Bola Tinubu says Nigeria’s investment environment operates on the principle of ‘a willing-buyer and willing-seller’, which ensures seamless access to capital for investors both within and outside the country.

The President gave the assurance on Sunday in Riyadh, Saudi Arabia, during a meeting with the President and Chief Executive Officer of Samsung, Hong Namkoong, and the Chairman of Samsung Investment Global, Jungwook Kim.

The meeting took place on the margins of the World Economic Forum Special Meeting on Global Collaboration, Growth and Energy for Development.

”Nigeria is a very huge country with a huge and able population. We have vibrant youths ready to learn and progress. In fact, our young do not wait for us. They go ahead of us in their determination to succeed. We must keep up and provide opportunities for them to excel with. We have an infrastructure deficit and you can take advantage of that and invest early and deeply in an environment that is absorptive and ready for it. It is modeled after a willing-buyer and willing-seller arrangement. Easy capital in and easy capital out.

The President took time to detail the significant opportunities across sectors for investment within the Renewed Hope Infrastructure Development Fund, which involves the potential utilization of co-finance instruments on critical infrastructure and technology which Samsung is well known to produce.

President Tinubu also harped on the importance of deepening collaboration in the crude oil, natural gas, renewable energy, engineering, technology and agriculture sectors, emphasizing the potential for vast private sector participation in the establishment of fully-embedded, off-grid, cold-chain integration across sub-industries in the agriculture sector to forestall post-harvest losses with mass refrigeration capacity.

President Bola Tinubu says his administration is investing in technology that is tailored towards ensuring transparency and accountability in government and accelerating public-sector performance and service delivery to the Nigerian people.

Speaking during a meeting with Microsoft Founder and Philanthropist, Mr. Bill Gates, on the sidelines of the World Economic Forum Special Meeting in Riyadh, Saudi Arabia, on Sunday, President Tinubu said technology is a potent weapon against corruption and financial impropriety in public service.

Emphasizing his unwavering commitment to deliver reliable technology that will support a national consumer credit system and many other critical new government interventions for all Nigerians, the President said resistance is often expected when efforts are made to strengthen systems and forestall malfeasance.

“Technology is the enemy of fraud, corruption, and irregularity. We have been working hard on improving technology.

“There is always the initial resistance. Corruption, self-interest, and fraudulent activity will always be an enemy, but when you bend that curve, you will receive the benefit. The nation will receive the benefit,” the President said.

Recounting how he deployed technology to enhance the revenue base of Lagos State as governor, President Tinubu said he ensured the collection and utilization of essential data, creating an efficient tax system for the state.

“When I was governor of Lagos State, I faced challenges. I started with N600 million and ended up with over N8 billion. And right now, they are targeting a trillion naira with the use of technology in the state. There is no other shortcut. We must invest in technology. We must focus, be diligent, and work hard,” the President said.

In his remarks, Mr. Gates informed the President of a one-identity technological platform that can integrate variegated data, while explaining the centrality of data harmonization to planning, security, and tax efficiency.

“We are working with Mr. Wale Edun, the Coordinating Minister of the Economy and Minister of Finance, on digitization. Before you came into office, there were a few things attempted in identity management. But they have been very scattered. There have been multiple identification systems.

“Now, there is a plan to take that technology called MOSIP and use it for this identification platform so that people can get digital benefits. We are providing support for that, and we can provide more support.

“With MOSIP ID, there is potential application in all government payment programmes. It helps with payment efficiency and bank accounts, and eventually, when everyone is using that, it makes tax collection easier. That benefit will take a few years. However, there will be more bank accounts, more financial inclusion, and effective government payment programmes,” the former Chief Executive Officer of Microsoft said.

Mr. Gates said Nigeria has the capacity to manage this system and related-technological systems as the nation brims with talented youths.

“The last time I went to the Microsoft office in Lagos, I saw the amazing work that they were doing and how they were growing their operations. So, you have a lot of Nigerian talents to manage these systems,” he said.

The businessman also spoke about some high-yield seeds and a variety of crops with the potential for improved productivity and nutrition in all regions of the country.

He said countries like the United States and Brazil have been using these seeds and that they have been tested and certified as safe.

“There is no safety issue with these seeds. Supporting the Minister of Agriculture’s effort in this regard is something that we feel is important and worth supporting,” Mr. Gates added.

Responding to Mr. Gates’ submission, President Tinubu said: “We will look at this and work on it further. I am proud of Nigeria’s youths. They are very excited and creative with technology. They encourage us as we continue to press our reform efforts forward for their future prosperity. This is Nigeria’s time to become what it ought to be.”

SERAP sues NNPC over failure to account for ‘missing $2.04bn, N164bn oil revenues’

 

 

 

Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit against the Nigerian National Petroleum Company (NNPC) Limited over the “failure to account for and explain the whereabouts of the alleged missing USD$2.04 billion and N164 billion oil revenues.”

 

 

 

The suit followed the allegations documented in the recently published 2020 audited report by the Auditor General of the Federation that the NNPC failed to remit the money into the Federation Account, saying that the money may have been diverted.

 

 

 

In the suit number FHC/ABJ/CS/549/2024 filed last Friday at the Federal High Court in Abuja, SERAP is seeking: “an order of mandamus to direct and compel the NNPC to account for and explain the whereabouts of the missing USD$2.04 billion and N164 billion oil revenues, as documented in report by the Auditor-General.”

 

 

 

SERAP is seeking: “an order of mandamus to compel the NNPC to hand over suspected perpetrators to the Independent Corrupt Practices and Other Related Offences Commission (ICPC) and the Economic and Financial Crimes Commission (EFCC) for investigation and prosecution.”

 

 

 

SERAP is also seeking: “an order of mandamus to compel the NNPC to ensure the full recovery and remittance of the missing USD$2.04 billion and N164 billion into the Federation Account.”

 

 

 

In the suit, SERAP is arguing that: “There is a legitimate public interest in providing the details sought. The NNPC has a legal responsibility to account for and explain the whereabouts of the disappeared money.”

 

 

 

SERAP is arguing that, “The missing oil revenues have further damaged the already precarious economy in the country and contributed to high levels of deficit spending by the government.”

 

 

 

SERAP is also arguing that, “Without the full recovery and remittance of the missing USD$2.04 billion and N164 billion oil revenues, the dire economic situation may worsen and Nigerians will continue to be denied access to basic public goods and services.”

 

 

 

According to SERAP, “the Auditor-General has for many years documented reports of disappearance of public funds from the NNPC. Nigerians continue to bear the brunt of these missing oil revenues.”

 

 

 

The suit filed on behalf of SERAP by its lawyers, Kolawole Oluwadare and Kehinde Oyewumi, read in part: “The alleged missing oil revenues reflect a failure of NNPCL accountability more generally and are directly linked to the institution’s continuing failure to uphold the principles of transparency and accountability.”

 

 

 

“The failure by the NNPC to account for and explain the whereabouts of the disappeared money is a grave violation of the provisions of the Nigerian Constitution 1999 [as amended], the Freedom of Information Act, national anticorruption laws, and the country’s obligations under the UN Convention against Corruption.”

 

 

 

“Had the NNPCL and its subsidiaries accounted for and remitted the disappeared public funds into the Federation Account, it is likely that more funds would have been allocated to the fulfillment of economic and social rights of Nigerians, such as increased spending on public goods and services.”

 

 

 

“The missing oil revenues have also impeded Nigerians’ ability to enjoy their economic and social rights, and denied them access to essential public goods and services, especially at the time of cost of living crisis in the country.”

 

 

 

“Nigerians have the right to know the whereabouts of the disappeared oil money. Ensuring transparency and accountability in the management of oil revenues would advance the right of Nigerians to restitution, compensation and guarantee of non-repetition.”

 

 

 

“According to the recently published 2020 audited report by the Auditor General of the Federation (AGF), the NNPC failed to remit over USD$2 billion and N164 billion oil revenues into the Federation Account.”

 

 

 

“The Auditor-General fears that the money may have been diverted into private pockets, denying the government the funding needed to carry out its activities.”

 

 

 

“The NNPCL reportedly failed and/or refused to remit N151,121,999,966. The NNPCL without any justification deducted the money from the oil royalties assessed for 2020 by the Department of Petroleum Resources (DPR) now Nigerian Upstream Petroleum Regulatory Commission (NUPRC).”

 

 

 

“The NNPCL has failed to account for the missing public funds. The Auditor-General wants the money recovered and remitted into the Federation Account.”

 

 

 

“The NNPCL also failed to remit USD$19,774,488.15 collected as government revenue into the Federation Account. The Auditor-General wants the NNPCL to account for the money, recover and remit it into the Federation Account, and to hand over those suspected to be involved to the ICPC and the EFCC.”

 

 

 

“The NNPCL also reportedly failed to account for USD$2,021,411,877.47 and N13,313,565,786.49 of royalties collected from crude oil and gas sales and gas flare.”

 

 

 

“The Auditor-General wants the public funds fully recovered and remitted into the Federation Account and for those suspected to be responsible for the missing public funds to be handed over to the ICPC and the EFCC.”

 

 

 

“Despite the country’s enormous oil wealth, ordinary Nigerians have derived very little benefit from oil money primarily because of widespread grand corruption, and the entrenched culture of impunity of perpetrators.”

 

 

 

“SERAP notes that Section 15(5) of the Nigerian Constitution 1999 (as amended) requires public institutions to abolish all corrupt practices and abuse of power.”

 

 

 

“Section 16(2) of the Nigerian Constitution further provides that, ‘the material resources of the nation are harnessed and distributed as best as possible to serve the common good.’”

 

 

 

“Section 13 of the Nigerian Constitution 1999 [as amended] imposes clear responsibility on the NNPCL to conform to, observe and apply the provisions of Chapter 2 of the constitution.”

 

 

 

“Paragraph 3112(ii) of the he Financial Regulations 2009 provides that, ‘Where a public officer fails to account for government revenue, such officer shall be surcharged for the full amount involved and such officer shall be handled over to either the Economic and Financial Crimes Commission (EFCC) or the Independent Corrupt Practices and Other Related Offences Commission (ICPC).’”

 

 

 

“Nigeria has made legally binding commitments under the UN Convention against Corruption to ensure accountability in the management of public resources. Articles 5 and 9 of the UN Convention against Corruption also impose legal obligations on the NNPCL to ensure proper management of public affairs and public funds. These commitments ought to be fully upheld and respected.”

SERAP sues Akpabio ‘over failure to recall Ningi, refer N3.7trn budget padding to EFCC, ICPC’

 

Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit against the Senate President, Mr Godswill Akpabio over “the failure to refer the alleged N3.7 trillion budget padding to appropriate anti-corruption agencies for investigation and prosecution, and to recall Senator Abdul Ningi who blew the whistle on the allegations.”

Mr Akpabio is sued for himself and on behalf of all members of Nigeria’s Senate.

It would be recalled that whistleblower Ningi last month was suspended for three months over his allegations that the 2024 budget was padded by over N3 trillion and that the country is operating two budgets.

In the suit number FHC/ABJ/CS/452/2024 filed last Friday at the Federal High Court, Abuja, SERAP is seeking: “an order of mandamus to direct and compel Mr Akpabio to refer the alleged N3.7 trillion budget padding to appropriate anti-corruption agencies for investigation and prosecution of suspected perpetrators.”

SERAP is also seeking: “an order of mandamus to direct and compel Mr Akpabio to immediately take steps to ensure the reinstatement of whistleblower Abdul Ningi who was suspended from the Senate over his allegations that the lawmakers padded the 2024 budget by irregularly inserting projects worth N3.7 trillion.”

SERAP is also seeking: “an order of mandamus to direct and compel Mr Akpabio to put in place transparency and accountability mechanisms to ensure that the trillions of Naira budgeted for constituency projects are not embezzled, misappropriated or diverted into private pockets.”

In the suit, SERAP is arguing that: “Granting this application would serve the public interest, encourage whistleblowers to speak up, improve public services, and ensure transparency and accountability in the management of public resources.”

SERAP is arguing that, “Directing Mr Akpabio to refer these allegations to appropriate anticorruption agencies and to reinstate whistleblower Abdul Ningi would be entirely consistent and compatible with the letter and spirit of the Nigerian Constitution 1999 [as amended] and the country’s international obligations.”

SERAP is also arguing that, “The allegations by Senator Ningi amount to public interest disclosures and can contribute to strengthening transparency and democratic accountability in the Senate in particular and the country as a whole.”

According to SERAP, “Suspension of Senator Ningi by the Senate followed a seriously flawed process and it amounts to retaliation.”

SERAP is also arguing that, “Senator Ningi’s status as a whistleblower is not diminished even if the perceived threat to the public interest has not materialised, since he would seem to have reasonable grounds to believe in the accuracy of the allegations of budget padding and corruption in the Senate.”

The suit filed on behalf of SERAP by its lawyers, Kolawole Oluwadare and Mrs Adelanke Aremo, read in part: “It is in the public interest and the interest of justice to grant this application. No whistleblower should ever be penalised simply for making a public interest disclosure.”

“Directing Mr Akpabio to refer the allegations to appropriate anticorruption agencies would help to address the lingering problem of budget padding and corruption in the implementation of constituency projects.”

“Directing Mr Akpabio to refer the allegations to the Independent Corrupt Practices and Other Related Offences Commission (ICPC) and Economic and Financial Crimes Commission (EFCC) would also ensure probity and accountability in the budget process.”

“Investigating and prosecuting the allegations of budget padding and corruption would end the impunity of perpetrators. It would build trust in democratic institutions with the ultimate aim of strengthening the rule of law.”

“Years of allegations of budget padding and corruption in the implementation of constituency projects have contributed to widespread poverty, underdevelopment and lack of access to public goods and services.”

“Allegations of budget padding and corruption in the implementation of constituency projects have also continued to have negative impacts on the fundamental interests of the citizens in several communities and the public interest.”

“Combating budget padding would improve access of Nigerians to basic public goods and services, and enhance the ability of ministries, departments and agencies to effectively and efficiently discharge their constitutional and statutory responsibilities.”

“Section 15(5) of the Nigerian Constitution requires public institutions to abolish all corrupt practices and abuse of power.”

“Section 16(2) of the Nigerian Constitution further provides that, ‘the material resources of the nation are harnessed and distributed as best as possible to serve the common good.’”

“Section 13 of the Nigerian Constitution imposes clear responsibility on the National Assembly including the Senate to conform to, observe and apply the provisions of Chapter 2 of the constitution.”

“Section 81 of the Nigerian Constitution and sections 13 and 18 of the Fiscal Responsibility Act constrain the ability of the National Assembly to unilaterally insert its own allocations in the budget without following the due process of law.”

“Nigeria has made legally binding commitments under the UN Convention against Corruption to ensure accountability in the management of public resources.”

“Articles 5 and 9 of the UN Convention against Corruption also impose legal obligations on the National Assembly including the Senate to ensure proper management of public affairs and public funds.”

“Article 33 of the Convention requires government institutions including the Senate to ensure the protection of whistleblowers against any unjustified treatment. Granting this application would ensure that these commitments are fully upheld and respected.”

“Senator Ningi is a whistleblower, who is protected under article 33 of the UN Convention against Corruption to which Nigeria is a state party. Senator Ningi is a whistleblower because of his public interest disclosures on alleged budget padding and corruption in the Senate in the context of carrying out his work as Senator.”

“According to our information, Senator Abdul Ningi, the former Chairperson of the Northern Senators Forum (NSF), recently told BBC Hausa that the lawmakers sought the service of a private auditor and discovered irregularities in the budget.”

“Senator Ningi reportedly said, ‘For example, we had a budget of N28 trillion but after our thorough checks, we found out that it was a budget of N25 trillion. How and where did we get the additional N3 trillion from, what are we spending it for?.’”

“According to BudgIT, a total of 7,447 projects culminating in N2.24tn were indiscriminately inserted in the 2024 budget by the National Assembly. 281 projects worth N491bn, and 3,706 projects within the range of N100–500m, worth 759bn were inserted in the budget.”

AIYEDATIWA SACKS ALL COMMISSIONERS APPOINTED BY AKEREDOLU

The Governor of Ondo State, Lucky Aiyedatiwa, on Wednesday, dissolved the State Executive Council, with immediate effect.

“All members of the Cabinet (who were appointed by late Governor Rotimi Akeredolu) are to immediately hand over to the Permanent Secretaries or the most senior administrative officers in their respective offices,” the governor’s spokesman, Ebenezer Adeniyan, said in a statement.

 

Aiyedatiwa also relieved all Senior Special Assistants (SSAs) and Special Assistants (SAs) of their duties.

 

“All the affected officials are directed to hand over all government properties in their possession.

 

“The Governor thanks the affected officials for their services and contributions to the development of the State.”

Aiyedatiwa, formerly Ondo deputy governor, was sworn in as the substantive governor of the South-West state on December 27, 2023, following the death of Akeredolu.

 

The former deputy governor survived an impeachment plot by some Akeredolu’s allies in the Ondo State House of Assembly when the ex-governor was ill.

ONDO ASSEMBLY TO SCREEN AIYEDATIWA’S NOMINEE AS DEPUTY GOVERNOR THURSDAY

Olayide Owolabi Adelami, the nominee for the position of deputy governor of Ondo state, is scheduled to undergo screening before the Ondo State House of Assembly on Thursday.

The Speaker of the Ondo Assembly, Olamide Oladiji, announced this during Wednesday’s plenary after reading a letter from Governor Lucky Aiyedatiwa.

Aiyedatiwa, has nominated a kinsman of late former Governor Oluwarotimi Akeredolu, Olayide Adelami, as his deputy governor.

Chief Adelami who hails from Owo, Owo local government area, retired as Deputy Clerk to the National Assembly l in April 2018.

Adelami was an APC governorship aspirant in 2020 but stepped down for the late Akeredolu.

He was first enlisted into the Federal Civil Service as an Accountant II in December 1983 and later posted to resume to the Treasury Department of the Accountant General of the Federation office.

NDLEA INTERCEPTS 1,274 PARCELS OF COCAINE, COLORADO IN LAGOS, 5.6M OPIOID PILLS IN KANO

Operatives of different special units of the National Drug Law Enforcement Agency, NDLEA, have intercepted large consignments of Cocaine and Colorado, a strong strain of cannabis, concealed in containerized household items and vehicles imported from Durban, South Africa and Canada at the Tincan Seaport in Lagos.

Following coordinated intelligence and months of tracking of the containers by three special units of NDLEA, the illicit drugs along with arms, ammunition and sundry military effects were seized during joint examination of the three containers by the Agency’s officers and their counterparts from Customs Service and other security agencies between Thursday 18th and Friday 19th January 2024. Some of the Agency’s sniffer dogs were also deployed to help identify locations and bags used in concealing the illicit items.

Some of the items recovered from the containers include: 1, 274 parcels of Cocaine and Colorado with a total weight of 884.09 kilograms; four pistols; 197 rounds of 9mm ammunition, 49 rounds of 7.62mm ammunition, 275 rounds of 5.56mm ammunition, 14 rounds of 9mm ammunition and sundry military personnel effects as well as some chemicals in kegs. With the exception of 32.5kg shipment of Colorado that came in used vehicles from Canada, the rest of the items were found in two of three containers that arrived the Tincan port from Durban, South Africa onboard a vessel marked MSC RESILIENT III and discharged on New Year eve, 31st December 2023.  A suspect linked to one of the containers, UACU 5348336, bearing the 32.5kg Colorado, 41-year-old Akara Chibugo has already been tracked and arrested by NDLEA operatives.

Two vigilant freight agents and a traveler escaped being roped into two drug trafficking operations by desperate traffickers at the Murtala Muhammed International Airport, MMIA Ikeja Lagos. The two agents were contacted to send a consignment of 1kg cannabis concealed in tins of Milo beverage to Turkey but chose to submit the shipment to NDLEA checks before processing the cargo. The psychoactive substance was later discovered to be hidden inside the shipment.

 

 

 

In the same vein, NDLEA operatives on Friday 19th January arrested one Okosun Paul Punitt, the consignee of a consignment of tramadol concealed in a bottle of dietary supplements, which a staff of Pathfinder International Ltd, Ajuzieogu Mac-Elvis Ugochukwu attempted sending through an intending passenger on Ibom Air to Accra, Ghana at the Lagos airport on Tuesday 16th January. A video of the face-off between the passenger and Ajuzieogu later went viral after the vigilant passenger suspected the consignment contained illicit substances. Both Ajuzieogu and the exhibit were later transferred to NDLEA on Thursday 18th January by the Federal Airports Authority of Nigeria, FAAN for investigation. Preliminary findings by NDLEA showed the parcel contained 50 pills of tramadol 225mg concealed in a bottle of dietary supplements. A follow up operation by the Agency led to the arrest of Okosun upon his return from Ghana on Friday. He has in his statement confirmed ownership of the drug.

 

 

 

In Kano, no fewer than five million six hundred and fifty three thousand (5, 653,000) pills of tramadol 250mg and exol-5 were seized from three suspects. While Nura Abdullahi, 38, and Tahir Muhammad Mukhtar, 42, were arrested at Bacharawa area of Kano with 5, 404,000 pills of tramadol 250mg on Sunday 14th January, Yusuf Umar, 50, was nabbed at Gadar Tamburawa area of the state the previous day Saturday 13th January with 249,000 tablets of exol-5 by NDLEA operatives.

 

 

 

In Lagos, two suspects: Ali Abubakar and Murtala Sani were arrested at Ojodu Berger area on Tuesday 16th January with 110kg of cannabis sativa while 69kg of same substance was recovered from the hideout of a fleeing suspect in Akerele, Surulere same day. Not less than 2, 800 bottles of codeine-based cough syrup were recovered by NDLEA officers on Saturday 20th January during a raid operation at Aleyita FCT, Abuja. The suspected owner of the consignment, Jideofor Sochima is still at large.

 

 

 

While a total of 100, 510 pills of opioids were seized from a suspect, Ike Emmanuel, 35, on Thursday 18th January at Dan-Anacha village, Taraba state, NDLEA operatives in Abia state arrested 60-year-old Joseph Isiguzoro, as well as Emmanuel Eugene and Malachi Ndu in parts of Abia state with 34,200 pills of opioids. Isiguzoro was equally found with monetary exhibit totalling Two Million Eight Hundred and Eighty Five Thousand and Forty Five Naira (N2,885,045) only.

 

 

 

The War Against Drug Abuse, WADA, advocacy campaign of the Agency continued in equal measure in schools, markets, worship places and others across the country in the past week. Some of them include: WADA sensitization lecture at Federal University of Technology, Ikot Abasi, Akwa Ibom; Federal Government College, Ijanikin, Lagos; Edusoko University, Bida, Niger state and WADA advocacy lecture at Community Secondary School, Bichi, Kano state, among others.

 

 

 

While commending the officers and men of Tincan, MMIA, Abia, Taraba, Lagos, Kano and FCT Commands as well as the special units of the Agency for the arrests and seizures of the past week, Chairman/Chief Executive Officer of NDLEA, Brig. Gen. OLUKOYEDE TASKS AUCTIONEERS ON PROBITY, FAIRNESS

Executive Chairman of the Economic and Financial Crimes Commission, EFCC, Ola Olukoyede  has charged auctioneers in the country to be guided by probity, fairness and accountability in the disposal of assets and other engagements relevant to their profession.

 

He gave the charge on Monday, January 22, 2024 when the executives of the National Association of Auctioneers,  NAA, led by their President, Alhaji Musa Kurra Abubakar paid him a courtesy visit at the Commission’s headquarters.

 

Olukoyede who spoke through the Commission’s Secretary, Mohammad Hammajoda stated that “you are expected to operate at a moral high ground. The probity, fairness and accountability you are expected to bring to your job are the core values that drive our work in the Commission. I can therefore say that we are together in the war against corruption.”

 

While noting that the visit testified to the good working relationship between the Commission and the Association, the Chairman pledged enhanced  commitment  of the EFCC to the relationship. “We are committed to the success of your Association.  We can work together and continue to pursue the goal of making Nigeria better for all of us. Luckily enough,  we have up to 18 members of your Association that we are working hand-in-hand with in the disposal of assets that have been forfeited to the government. And they are doing creditably well”,  he said.

 

In his remarks, NAA’s President,   Abubakar stated that the mission of the Association was to congratulate the Chairman and Secretary on their new appointments,  noting that NAA and the Commission have been long-term partners in progress.

 

“We are grateful for the opportunity you gave us to come and have a chat with you. We have been partners in progress for quite a long time and we feel it is right for us to pay a courtesy call since there has been a change of baton in the Commission and show our support to the new Chairman and Secretary”, he said.

 

The  Association later made a presentation of a giant souvenir, bearing the image of the Chairman and a congratulatory message to him.

EFCC ARRESTS 24 SUSPECTED TRAINEE INTERNET FRAUDSTERS IN UYO

Operatives of the Uyo Zonal Command of the Economic and Financial Crimes Commission, EFCC, have arrested Twenty Four , 24,  suspected  internet fraudsters being trained for  internet crimes in Uyo,  Akwa Ibom State.

 

They were arrested on Monday, January 22,  2024  at a storey building  suspected to be a criminal hideout for training internet fraudsters.

 

The all- male suspects were arrested in two locations in an intelligence-driven sting operation at D-Line Ewet Housing Estate and Nelson Mandela area both in Uyo, Akwa Ibom State.

 

They were rounded up at the upper floor of the storey building that looked like a classroom hall with chairs, tables, laptops and notepads on each table. The building is allegedly being  used solely for the training of youths in various aspects of cyber criminality.

 

Items recovered from the premises and the suspects include: five exotic cars; 18 laptops; 17 mobile phones and one internet router.

 

The EFCC had,  on November 28, 2019 arrested 23  trainers and trainees  at a “Yahoo Academy” at Essien Essien Street, Ikot Ibiok village in Eket Local Government Area of Akwa Ibom State. 

 

The suspects would be charged to court as soon as investigations are concluded.

ALLEGED N2BN FRAUD: COURT ADMITS FRESH EXHIBIT AGAINST EMMANUELLA ETETA ITA, HEAD OF STAKEHOLDERS UNIT OF THE FEDERAL INLAND REVENUE SERVICES, FIRS AND SURESTART SCHOOL LTD

 

Justice F. Giwa Ogunbanjo of  Federal High Court sitting in Abuja  on Monday, January 22, 2024 admitted a fresh exhibit  against Emmanuella Eteta Ita, Head of Stakeholders Unit of the Federal Inland Revenue Services, FIRS and Surestart School Ltd in a trial within trial to determine the admissibility of her statement with the Economic and Financial Crimes Commission, EFCC.

 

Ita and Surestart School Ltd are standing trial  on 25-count charges  bordering on criminal misappropriation, diversion, criminal breach of trust and money laundering  to the tune of N2billion.

 

Ita’s counsel, Paul Erokoro had objected to the admissibility of the statement of her client before the court,  claiming that it was exacted from her under duress and in the absence of her counsel. This came even as the defendant reportedly volunteered her statement to EFCC’s investigators in the presence of Eka Didara-Abasi Akpata, a lawyer from Federal Inland Revenue Service, FIRS, who accompanied her to the EFCC office.

 

Ruling on the matter on Monday, Justice Ogunbanjo stated that the defence did not prove beyond reasonable doubt that the statement of the defendant was not voluntary. Citing Section 15 of the Administration of Criminal Justice Act, 2015, he further stated that electronic recording of a defendant’s statement was not mandatory, so also the presence of a defendant’s counsel. With the ruling, the statement was admitted in evidence and marked “Exhibit 25.”

 

Further on the matter, Ijeoma Matilda, an EFCC operative,  led in evidence by prosecuting counsel,  Ekele Iheanacho,  concluded her testimony on the matter. According to her, information provided by System Specs, a Federal government Remittance payment platform through which funds were allegedly funneled into Surestart School Ltd between 2017 and 2018, amounted to N173,346,391.50. Surestart School Ltd is the second defendant, owned by the first defendant.

 

“We observed that there were transfers to the tune of N145,218,000 from the account of the first defendant to the second defendant, Surestart School Ltd. During the reconciliation with the defendant`s account she could not provide documents to justify the sum of N 158million which is the total money that came to her account. And in a bid to explain, she brought copies of receipts she signed which she claimed were receipts for Lomein Express Ltd. We contacted the owner of Lomein Express Ltd who said that the receipts did not emanate from them. She also brought letters of reimbursement, we invited all the  companies she mentioned and they all denied that the receipts were from them while other addresses do not exist,” she said.

 

While the first defendant also claimed that she resigned as the director of Surestart School Ltd, the prosecution witness revealed that documents from the Corporate Affairs Commission, CAC established that she was the owner of the school.

 

 

Speaking further, the witness stated that Ita has refunded about N19.5million so far, which was made at different dates into the EFCC`s account domiciled with the CBN.

 

According to the witness, “We requested for her salary account with Federal Inland Revenue Services, FIRS. In the course of analyzing the account, we discovered that around 2016, a huge sum of money was moved into the second defendant`s  account and that over N277million had entered into her salary account apart from her allowances, which were funds for travel allowance and entertainment expenses.”

 

Matilda further revealed that the frequency of money paid by the first defendant into the second defendant’s account increased from February 2016 with every of her salary being transferred to the second defendant’s account.

N320M MONEY LAUNDERING CHARGE: YOU HAVE A CASE TO ANSWER – COURT TELLS HOUSE OF REPRESENTATIVES MEMBER, NICHOLAS MUTU 

Justice F. Giwa Ogunbanjo  of the Federal High Court sitting in Abuja, on Monday, January 22, 2024  told a member of the House of Representatives, Nicholas Mutu  that he has a case to answer in an alleged N320 million money laundering case brought against him by the Economic and Financial Crimes Commission, EFCC.  

 

Mutu alongside Airworld Technologies Ltd and Oyien Homes, were dragged before the court by the EFCC on an amended 13 -count charge bordering on money laundering and gratification to the tune of N320m between August 2014 and August 2016. He was arraigned before the court while he was serving as the Chairman,  House of Representatives’ Committee on the Niger Delta Development Commission, NDDC.

 

The prosecution, at the last adjourned date, closed its case after presenting four witnesses, while the defense made a no- case submission.

 

 Justice Ogunbanjo while ruling on the no- case submission on Monday, January 22, 2024, told the defendant to enter his defence, ruling that the prosecution had presented sufficient evidence to establish a prima facie case against Mutu.

 

The EFCC counsel, Ekele Iheanacho, in his objection to the ‘no case submission’  by the defense, argued that the money paid to the defendants by Starline Consultancy, a contractor to NDDC, was  gratification.

 

Iheanacho further told the court that Mutu used his official position, as the chairman of the House Committee on NDDC, to influence the payment of money paid by the NDDC contractors, using Airworld Technologies Ltd.

 

After ruling that Mutu had a case to answer, Justice Ogunbanjo adjourned the case till February 21 and 22, 2024.

YUSUF AMINU BAGS THREE YEARS JAIL TERM FOR N1.6M FRAUD IN BAUCHI

The Gombe Zonal Command of the Economic and Financial Crimes Commission, EFCC, has secured the conviction and sentence of one Yusuf Aminu before Justice A.M Sambo of the Bauchi State High Court. Aminu bagged three years imprisonment for dishonesty and obtaining by false pretence.

 

He was arraigned by the Gombe Zonal Command of the EFCC on one-count charge bordering on obtaining by false pretences.

 

The one-count charge reads: “That you Yusuf Aminu (trading under the name and style of Yusuf Aminu General Enterprises ) sometimes in January 2021  at Bauchi, Bauchi State, within the jurisdiction of this honourable court with intent to defraud, dishonestly obtained the sum of N1,600,000.00 from First City Monument Bank by falsely representing that the said sum was for the improvement and enhancement of your working capital which pretence you knew  to be false and thereby committed an offence contrary to Section 320 and punishable under Section 322 of the Penal Code Law.”

 

He pleaded “guilty” to the charge, following which prosecution counsel, Mubarak Tijani prayed the court to convict and sentence him accordingly, while his counsel, Adamu Baba prayed the court to temper justice with mercy, stating that the defendant has become remorseful and made full restitution to his victim.

 

Justice Sambo convicted and sentenced him to three years imprisonment with an option of fine of  N50,000 (Fifty Thousand Naira).

 

Aminu began his journey to the Correctional Centre when he obtained a loan from First City Monument Bank to enhance his business.  He neither used the loan for his business nor repaid the bank that offered him the loan

 

 

In another development, the Gombe Zonal Command of the Commission on January 18, 2024 arranged one Dare Dammas Luggard before Justice J.D. Longden of the Plateau State State High Court, sitting in Jos.

 

Luggard was arraigned on six-count charges  bordering  on intent to defraud and obtaining by false pretence to the tune of N11,550,000.00 (Eleven Million Five Hundred and Fifty – thousand Naira).

 

One of the charges  reads: “That you  Dare Dimmas Luggard sometimes in 2021 in Jos, Plateau State, within the jurisdiction of this honourable court did with intent to defraud, induced Samalia Isa Kudi to deliver to you the sum of  Four Million and Five Hundred Thousand Naira (N4,500,000.00)  under the pretence  that you were contracted to deliver 10,000 bags of maize to internally displaced persons and that his profit is monthly  and his capital will be pulled out at his will, which you never did, instead you diverted the said sum to your personal use and thereby committed an offence contrary to Section 320 and punishable under Section 322 of the Penal Code.”

 

He pleaded “not guilty” to all the charges, prompting prosecution counsel, A.B. Kware to pray the court for a trial date while the defence counsel, A.S. Amaleh informed the court of an existing bail application for the defendant.

 

Justice Longden granted the defendant bail in the sum of N5 million and  two sureties in like sum. One of the sureties must be a district head in the defendant’s community.

 

The judge remanded him in Jos Correctional Centre pending the fulfillment of his bail conditions and adjourned the matter till March 19, 2024 for continuation of trial.

Sherrif Oberevwori as the duly elected Governor of Delta State. As the final court of the land, all citizens are bound to accept and abide by its decisions even if they do not accord with their personal or collective expectations of justice. So, we ask our people to respect today’s decision and give their best to promote peace everywhere in our beloved Delta State. The unity, peace, and general good of our dear State are bigger and more important than any individual or group interest.

2.0. Having responsibly and fully played our role in principled defence of our fervent belief in the truth, honour and justice of our case and cause as democrats, we must now yield all to posterity, even as we thank God Almighty who gave us the grace to stand in the first place. Here, I must first thank my beloved wife, our dear children and great family for their huge sacrifices in my quest to offer innovative and caring leadership to our people.

PRESIDENT TINUBU DIRECTS EXPANSION OF STUDENT-LOAN PROGRAMME TO INCLUDE SKILL DEVELOPMENT

President Bola Tinubu has directed the management of the Nigeria Education Loan Fund (NELFUND) to expand its focus area by extending interest-free loans to Nigerian students interested in skill-development programmes.

The President issued this directive at the State House on Monday after a briefing from Mr. Akintunde Sawyerr, Executive Secretary of NELFUND, on the build-up to the launch of the programme later in the month.

The President said it is important for the scheme to accommodate those who may not want to pursue university education, noting that skill acquisition is as important as obtaining undergraduate and graduate academic qualifications.

“This is not an exclusive programme. It is catering to all of our young people. Young Nigerians are gifted in different areas. This is not only for those who want to be doctors, lawyers, and accountants. It is also for those who aspire to use their skilled and trained hands to build our nation. In accordance with this, I have instructed NELFUND to explore all opportunities to inculcate skill-development programmes because not everybody wants to go through a full university education,” he said.

President Tinubu emphasized the need for equity and inclusivity in the management of the programme, stating: “No matter how economically challenged you are, accredited and qualified students will and must have access to this loan to advance their education in higher institutions. There is no compromise in our commitment to the disadvantaged citizens of this nation.”

In his presentation to the President, Executive Secretary of the Fund, Mr. Akintunde Sawyerr, said the loan application process will be technology-driven, limiting human interface and “eliminating any possibility of maladministration in the programme.”

“By design, this is a perpetual programme and will not terminate. The funds, earmarked for bona-fide Nigerian students, will be disbursed directly to the institutions in the initial phase through electronic transfer. Our students will be catered to in a way that bypasses human interference through the full utilization of available technological platforms, in adherence to Your Excellency’s stated objectives,” he said.

He also said NELFUND has developed a robust risk-mitigation mechanism to address potential risks that may arise from the programme.

Speaking on the funding mechanism of the programme, Dr. Zacch Adedeji, Executive Chairman of the Federal Inland Revenue Service (FIRS), said funding sources have been made available to ensure the smooth take-off and sustenance of the programme.

“Mr. President is permanently solving the problem of funding for education in Nigeria. By the directive of the President, the Education Tax Fund is being reviewed to additionally cater to the needs of our university students across all local government areas in the country as they seek to access vocational and traditional university education. Funding for the programme will be adequately covered,” he said.

“Let us dialogue because public condemnation of a nation is not what makes any citizen a good one. We must admonish Nigerians to have a change of mindset and not to make money our god or master. I believe we will get to the Promised Land, and Nigeria will flourish.

“We are here to listen, and if you observe any inadequacies in my government, let us know. I am here today because of your prayers and the will of God Almighty. What I have challenged myself to do each day is to be fair to all Nigerians. I have had a number of criticisms, including the rationale behind the size of my cabinet. If you want efficient, mobile, and resourceful people, we have to give people a load they can carry. If you combine too many ministries because you want to save money, you will have a future of non-performance and no results.

“Nigeria needs to turn the corner to grow, and we must give people challenges they can manage, and that is what we are doing,” the President firmly stated.

In his remarks, Archbishop Okoh urged President Tinubu not to relent in his efforts to provide good governance by ensuring security, inclusivity, and peaceful co-existence in the country.

“You have extended a hand of fellowship to us, and we embrace you and your family with the love of Christ and promise to partner with you in nation-building, for the task is quite daunting. You will not stumble, and you will not fall. We believe that you have the sagacity to give leadership in battling our challenges and in turning around the fortunes of our nation, Nigeria, within a short time. You have shown that you are a listening leader, and we appreciate this.

“CAN has maintained an active presence at all levels from the national to the grassroots, and we have remained non-partisan. You will always find our association as a ready and willing partner in nation-building,” Okoh said.

President Bola Tinubu has assured traditional rulers in the South-South geopolitical zone that his administration is committed to addressing their concerns over development and environmental degradation.

The President gave the assurance on Tuesday at the State House during a meeting with the South-South Monarchs Forum, led by His Royal Majesty, Major-General Felix Mujakperuo (Rtd), Chairman of the Delta State Council of Traditional Rulers, and Vice-Chairman of the South-South Monarchs Forum.

The President told the Royal Fathers that his administration is diligently working, both domestically and internationally, to strengthen Nigeria’s durability and approach to climate change, environmental restoration, infrastructure development, all while ensuring security and stability in the region.

Commending the monarchs for their understanding approach to his administration’s ongoing economic reforms, particularly the removal of the fuel subsidy, President Tinubu promised that Nigerians would soon enjoy the benefits of these tough, yet necessary decisions.

”We are working to revive the economy from the damage of several years. We seek your support, prayers, and understanding, and I am glad that the Vice-Chairman of the Forum served in an organization where we need intelligence to operate.

”You (the traditional institution) will be the source of the intelligence we need for the holistic development of our country, and anytime you need to tell us something, do not hesitate to reach out to this office. I will take on all of your concerns, and I will address each of them one by one.

”We cannot underestimate your contributions to the peace and stability of this country. Continue to uphold us in your prayers and in talking to our youths to keep faith with the country because light is already visible at the end of the tunnel,” the President said.

In his remarks, His Royal Majesty, Major-General Mujakperuo appealed to President Tinubu to follow up on all developmental efforts in the region to be sure that progress is tangible to the people.

“Mr. President, you know the problems of our region as an expert with experience in the energy industry. We see you working hard to solve our problems, and we are comforted that you have pledged to take on our concerns and bring a final solution to them,” the South-South Monarchs Forum Vice-Chairman said.

PRESIDENT TINUBU: OUR INTERVENTIONS IN OIL AND GAS SECTOR WILL SAFEGUARD AND ENHANCE VALUE OF INVESTMENTS

President Bola Tinubu says his administration will continue to provide the needed interventions in the oil and gas industry in line with the provisions of the Petroleum Industry Act (PIA).

Speaking when he received a delegation from the Chevron Corporation, led by Mr. Clay Neff, President of Chevron International Exploration and Production, on Tuesday in Abuja, President Tinubu said Nigeria would strengthen its long-standing partnership with the multinational company in line with the evolving dynamics in the oil and gas industry.

The President welcomed Chevron’s commitment to build on its investments in shallow and deep water operations in Nigeria, noting the company’s ongoing $1.4 billion drilling project with the Nigerian National Petroleum Company Limited (NNPCL).

He also commended Chevron for its dedication to reducing its carbon footprint in the country.

”You must see the PIA as a legacy law. We assure you of quick interventions and turnaround on any issue you may have in your operations in our country.

”Nigeria is proud of the 60-year partnership with Chevron, and we believe this partnership will be strengthened to add mutually-beneficial value for the benefit of your shareholders as well as the living standards and economic opportunities of our population,” President Tinubu said.

In his remarks, Mr. Neff pledged that the company would continue to operate in full adherence to the highest standards, even as it meets its investment commitments in Nigeria.

He highlighted the company’s contributions to domestic gas supply, noting the delivery of 25% gas through a joint venture with NNPC Limited.

He also said Chevron was scaling up its investments in the country with its recent efforts in a new phase of development to include: “the conversion, under the Petroleum Industry Act, of all the NNPCL/Chevron Nigeria Limited Joint Venture (JV) Oil Mining Leases (OMLs) and Agbami OML 127 to Petroleum Mining Leases and Petroleum Prospecting Licences (PPLs); entry into OPL 215 block to boost deep-water development opportunities; signing of 20-year renewal of three deepwater leases; commencement of seismic data acquisition in several deepwater leases; commencement of life extension work on the Agbami project, and, in partnership with NNPCL, securing of $1.4 billion financing to fund the NNPCL/CNL JV infill drilling programme between 2022 to 2026, which includes the drilling of 37 wells in the shallow offshore and onshore Escravos area and associated facilities”.

Mr. Neff further informed President Tinubu that Chevron’s average annual tax and royalty remittances over the past three years had reached $3.4 billion.

”The bold steps you have taken since you assumed office are quite impressive. We are encouraged by our partnership of over 60 years, and we look forward, God willing, to continue that partnership for many decades to come.

”We are also looking at other opportunities as well, while operating with the best environmental practices. We will continue to grow our traditional oil and gas business because we know the countries where we operate are in need of those products, and the world needs those products,” he said.

A PEOPLE’S ORODJE; BEING A TRIBUTE BY THE OKPE UNION TO ORHORO I, THE LATE ORODJE OF OKPE, ON THE 20TH YEAR MEMORIAL OF HIS PASSING.

 

Tomorrow 20th January, 2024, marks the 20th Anniversary of the transition unto glory of His Royal Majesty, Orhoro I, J.P; OON, the Orodje of Okpe in Delta State of Nigeria. He was the second Orodje of Okpe Kingdom of the modern era. The first Orodje of Okpe of the modern era, Esezi II had joined his ancestors on the 26th of March, 1966. Before the ascension of Esezi II into the exalted throne on the 1st of January, 1945, the Okpe Nation has had a monarchical interregnum of over one hundred and sixty years.

 

This long period without an Orodje (leader or king) was after the epic regicide in which the Okpe people eliminated their first Orodje  after they had concluded that Esezi I had become high handed and dictatorial against the type of office they had created which was a consultative and limited one and not a ruler with absolute powers. By the late 1930s and early 1940s, the Okpe Union was able to convince and mobilise the Okpe people to resolve that it was time to resuscitate the throne of the Orodje of Okpe. This the Okpe people succeeded in achieving in 1945 with the coronation of Esezi II who himself joined his ancestors in 1966.

 

Domingo Amujaine Ejinyere was crowned as Orhoro I, the Orodje of Okpe on the 30th of December, 1972 after his election by the accredited representatives of the the Orhoro Ruling House of the four ruling houses known as Adene Okpe (four gates of Okpe) and his acceptance by the Okpe people.

 

The newly crowned Orhoro I did not waste any time before taking steps to reassure the people that the Orodje Throne was for all Okpe people. Within a relatively short time he visited all communities of Okpe Kingdom. At each community town hall, there was arranged a befitting Royal Seat on which His Royal Majesty, Orhoro I sat to receive greetings and homage from his loving people. The memories of the feeling and spirit of grace, love, solidarity still remain with the generation of Okpe people that witnessed those visits and interactions with the people of the grassroot.

 

Orhoro I engendered love and unity and a sense of justice among the Okpe people throughout his reign. This heralded the decision by the Okpe people to hearken to the call and initiative by the Okpe Union under the leadership of Late Chief Philip Ewetuya as President General, to commence an all Okpe fund raising for the building of a Modern All Okpe Orodje Palace. This vision came to fruition when the then political leader of the Okpe people, the late Okakuro Sen. David Dafinone bought into the Okpe Union vision for the Okpe Modern Palace project. It was great relief and a sweet experience for the Okpe people to have witnessed Orhoro I moving into the All Okpe Orodje Modern Palace and being the first Orodje to have superintended over the Kingdom from there.

 

During his reign, Orhoro I occupied most offices attainable by a Traditional Ruler. He was First Vice Chairman, Midwest Council of Traditional Rulers (1973-1977); Deputy Chairman, Bendel State Traditional Rulers Forum (1977-1991); Member National Council of State (MNCS) 1992; Pioneer Chairman of the Delta State Council of Traditional Rulers (1993); and Chairman, Traditional Rulers of Oil Mineral Producing Communities (TROMPCON). Also during his reign, he was able to handle and resolve many intra and inter communal conflicts in Delta State.

 

Throughout his reign, there were no notable intra or inter communities conflicts in Okpeland as potential ones were always handled by him in dispassionate and conscientious manner. HRM Orhoro I made all Okpes proud with his carriage, gracefulness and love for his people. Orerokpe the ancestral headquarters of the Okpe Nation felt his love and presence. Okpe people felt throughout his reign, that he was their prayer answered.

 

The Okpe Union worked so closely with him to address the challenges of the Okpe Kingdom. On several occasions when the Okpe Union headquarters visited, he would rise and symbolically personally serve entertainment to the Okpe Union and express as follows:

 

“… allow me to personally serve them. If not for the Okpe Union, this throne I seat today would not be in existence…”

 

As we mark the 20th anniversary of the passing unto glory of Orhoro I, a gift of the Okpe Nation to the world, and with whom the Okpe people are always pleased, we on behalf of the members of the Okpe Union the world over, join his immediate family, and the entire Okpe Nation, to celebrate once again, the life and times of the People’s Monarch; the grassroot Orodje of the Okpe people. May he continue to rest in peace. Amen!

LAGOS BLUE RAIL LINE BEGINS COMMERCIAL OPERATIONS SEPTEMBER 4

The Lagos State Government on Wednesday announced that the Blue Line Rail will start commercial operations on Monday, September 4, 2023.

 

The Managing Director of the Lagos Metropolitan Area Transport Authority (LAMATA), Engr. Abimbola Akinajo, spoke on the commencement date during a press conference at the iconic Marina Station of the Blue Line Rail in Lagos.

 

Akinajo, who took reporters on a guided ride and tour of the physical infrastructure of the Blue Line Rail from the Marina Station to the National Arts Theatre Station in Iganmu, said Lagos State Governor, Mr. Babajide Sanwo-Olu would take the inaugural ride on the train at 9 a.m. on Monday, September 4, before other passengers begin to ride.

 

She said partial passenger operations will start on Tuesday from 6:30 am to 10 am for the morning peak and the afternoon Peak from 4 pm to 9:30 pm, adding that the operations will start with 12 trips for two weeks, which will later be increased to 76 trips per day.

 

Akinajo disclosed that though the train is electric, it would run on locomotive for the first four weeks of operation to allow the electric system to come up fully and sync properly with the physical infrastructure, adding that the plan is to allow passengers to get familiar with the rail system.

 

She said despite the train running on locomotive for the first four weeks, the tracks would remain energised so that passengers are not allowed to cross them.

 

The LAMATA boss said about 150,000 passengers are expected to board the train daily. “The train would run 12 trips in two schedules for now – 6.30 am to 10 am (morning peak) and 4.30 pm – 9 pm (evening peak). The train will stop for 90 seconds at each station. It will run 76 trips, from 5.30 am to 11 pm, when it becomes fully operational in four weeks,” she said.

 

The full length of the train trip from Marina – Mile 2, according to Akinajo will cost N750 but noted that the 50 percent discount announced by Governor Sanwo-Olu on all Lagos public transportation rides also applies to the train ride.

 

She said passengers can only access the service with their cowry cards, noting that cash or paper tickets would not be accepted.

 

Akinajo, who warned against eating and drinking on the train, said adequate security has been put in place for the security of lives and property, noting that anyone with criminal intent would be arrested and handed over to the Police as there are about 30 cameras along the tracks.

 

She said: “A full Journey from Marina to Mile 2 will cost N750 and Zonal fares will be between N400 and N500 for people not making the complete full trip. The transportation palliative announced by Governor Babajide Sanwo-Olu will also cover the Train system, meaning that the highest fare for the full trip will be N375.

 

“We are going to put safety measures in place. There are over 300 CCTV cameras across the whole Blue Line Rail and over 30 cameras monitoring the tracks alone. Command and Control centers are also available in all stations. Plain cloth security agents and officers of the Lagos Neighbourhood Safety Corps will ride with passengers at all times. Any altercation on the train will not be tolerated. Vandalism also will not be tolerated.”

 

Speaking on the initial delay in the commencement of the Blue Line Rail, which was earlier scheduled to commence operation in August, Akinajo said the delay was caused by prevailing circumstances around import and export.

 

She, however, noted that LAMATA is committed to starting operations on September 4 without any further delay since all the necessary things have been put in place for the operations of the Blue Line rail.

 

It would be recalled that President Muhammadu Buhari on January 24, 2023, in the company of Governor Sanwo-Olu and his deputy, Dr. Obafemi Hamzat, commissioned the first phase of the Blue Rail Line, which runs from Marina to Mile 2 and also witnessed the signing of the commencement of Phase 2 of the project from Mile 2 to Okokomaiko.

The Blue rail line, part of the Lagos Rail Mass Transit, will run 27.5 km from Marina to Okokomaiko, with 13 stations and an end-to-end journey time of 35 minutes.

PRESIDENT TINUBU SEEKS EXPEDITED PACE OF PROGRESS IN DIALOGUE AS ISLAMIC ULAMAS PREPARE TO CONTINUE TALKS WITH MILITARY JUNTA

The Chairman of the ECOWAS Authority of Heads of State and Government, President Bola Tinubu has implored a delegation of Islamic scholars (Ulamas), who were previously engaged in discussions to facilitate the restoration of constitutional democratic governance in Niger Republic, to expedite progress in their ongoing dialogue with the military junta.

The President received a comprehensive briefing on Thursday at the State House in Abuja, from the Ulamas, who were led into the meeting by Sheikh Bala Lau. The briefing followed the Ulamas’ two most recent visits to Niger Republic.

The Islamic leaders had informed the President that the military junta was open to deepening dialogue with ECOWAS as more steps are being taken to forestall armed conflict with a more detailed acceptance of the ECOWAS position by Niger military council officials.

Responding to the delegation of Ulamas, against the backdrop of ethnic rumors peddled by domestic political figures inside and outside of the country, President Tinubu emphasized that he is at the forefront of a peaceful resolution of the crisis, even in the midst of more hawkish individuals urging swifter intervention.

“I am managing a very serious situation. If you take ECOWAS aside, other people will react, those who are outside of our control. I am the one holding those sides back. I am the one holding back ECOWAS,” he disclosed.

Addressing the urgency of the situation, the president added:

”Even as at this morning, I have been inundated with phone calls on the readiness of countries with their military force and contributions. However, I told them to wait. I am meeting with the Ulamas and I will get back to you.”

President Tinubu told the Islamic delegation that the military junta must be held accountable for putting the entire people of Niger Republic in jeopardy.

”They cannot use the gun given to them to protect the sovereignty of the country and turn it against the people of the country,” he said.

President Tinubu pledged that ECOWAS will remain steadfast in its commitment to diplomatically engage with all stakeholders and seek a peaceful resolution to the impasse in Niger Republic.

“I will draw a line in the sand and ask you to make arrangements to go back to Niger Republic,” he stated.

On the request by the Islamic scholars for the Federal Government to monitor the distribution of palliatives to States, the President promised that more palliatives are coming for Micro, Small and Medium Enterprises (MSMEs) nationwide.

He also appealed to State governments to ensure transparency and accountability in the distribution and management of these palliatives.

“The people reside in the States. Even if I set up a panel, I will have to go through the governors and the local governments. We will continue to talk to the governors. Nigerians must hold them accountable,” he continued.

“It’s unheard of that in a constitutional democracy, a president will sit here and give orders to States. I can only appeal to them to implement. The people reside in the states, and if the Governor is not doing well, the people must vote them out,” he concluded.
